1. Acceptance of Terms
Welcome to The Pure Dentistry ("we", "our", "us", or "the Clinic"). By accessing, browsing, registering on, or using our website, application, or associated digital services (collectively, the "Platform"), you ("User", "Patient", or "Visitor") acknowledge that you have read, understood, and agree to be bound unconditionally by these Terms of Use ("Terms").
These Terms constitute a legally binding agreement between you and The Pure Dentistry. If you do not agree to these Terms, including the mandatory arbitration provision and class action waiver, you must immediately cease all access and use of our Platform. These terms apply globally to all users accessing our platform from the Republic of India or anywhere else in the world.
2. Eligibility
You must be at least eighteen (18) years of age, or the age of legal majority in your jurisdiction, to use our Platform. By using our Platform, you represent and warrant that you are legally capable of entering into binding contracts. If you are accessing the Platform on behalf of a minor, you represent that you are their parent or legal guardian and accept these Terms on their behalf.
3. Nature of Information and Medical Disclaimer
The content provided on this Platform—including text, graphics, images, articles, interactive tools, and other material—is strictly for informational and educational purposes only.
NO DENTIST-PATIENT RELATIONSHIP: The provision of information on this Platform or your use of our online booking systems, WhatsApp integrations, or contact forms does NOT create a dentist-patient relationship between you and any professional at The Pure Dentistry. Such a relationship is established only upon formal registration and an in-person physical consultation (or formal tele-consultation) with our licensed practitioners.
NOT MEDICAL ADVICE: Nothing on this Platform should be construed as medical, dental, or professional advice, diagnosis, or treatment. Always seek the advice of your dentist, physician, or other qualified healthcare provider regarding any medical condition. Never disregard professional medical advice or delay seeking it because of something you have read on our Platform. In case of a medical emergency, immediately call emergency services or proceed to the nearest emergency healthcare facility.
4. Teleconsultation and Online Booking Services
In providing online booking and potential teleconsultation services, The Pure Dentistry operates in compliance with the Telemedicine Practice Guidelines issued by the Ministry of Health and Family Welfare, Government of India, along with regulations under the National Medical Commission Act, 2019, and the Dentists Act, 1948.
- Accuracy of Information: When scheduling an appointment via the Platform, you agree to provide truthful, accurate, and complete information, including medical history if requested.
- Limitations of Remote Care: You acknowledge that online consultations rely on the information and imaging provided by you and may have limitations compared to an in-person examination. We reserve the right to mandate an in-person physical examination if our professionals determine remote consultation is insufficient.
5. Privacy and Data Protection
We are deeply committed to protecting your privacy and confidential health information. Our collection, processing, and storage of your personal data are strictly governed by our Privacy Policy, which is constructed in compliance with the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, and the Digital Personal Data Protection Act, 2023 (DPDP Act) of India.
By using our Platform, you explicitly consent to the collection and processing of your personal information, including sensitive medical and financial information, as defined under Indian law. We implement robust, industry-standard security measures, but we cannot guarantee absolute security against unauthorized cyber intrusions.
6. Payments, Cancellations, and Refunds
Where payments are required for consultations, bookings, or procedures facilitated online, you agree to use valid payment methods. All payments are processed through secure, RBI-authorized third-party payment gateways.
Cancellations: Appointments must be canceled or rescheduled at least 24 hours in advance. Failure to do so may result in full or partial forfeiture of any booking advances.
Refunds: Refunds for unrendered teleconsultation services or canceled bookings will be processed subject to our Refund Policy and back to the original payment method within 7-14 business days. No refunds are provided for completed dental procedures or services rendered, subject to applicable Indian consumer protection laws.
7. Intellectual Property Rights
All content on the Platform—including the brand name "The Pure Dentistry", logos, text, graphics, interface design, algorithms, and software—is the exclusive intellectual property of The Pure Dentistry or its licensors, protected under the Copyright Act, 1957, the Trade Marks Act, 1999, and the Information Technology Act, 2000 of India, as well as applicable international treaties.
You are granted a limited, personal, non-transferable, and non-exclusive license to access and use the Platform strictly for personal, non-commercial purposes. You may not reproduce, distribute, modify, reverse engineer, or scrape any part of our Platform without express written permission.
8. User Obligations and Prohibited Conduct
When using the Platform, you strictly agree NOT to:
- Violate any local, state, national, or international law or regulation.
- Provide false, deceptive, or misleading demographic or health information.
- Interfere with the security-related features of the Platform or transmit viruses, malware, trojans, or destructive code (as strictly prohibited under Section 43 and Section 66 of the Information Technology Act, 2000).
- Attempt to gain unauthorized access to our servers, databases, or restricted areas of the Platform.
- Harass, abuse, or use inappropriate and threatening language towards our dental professionals and staff across any communication medium.
We reserve the right to immediately terminate or suspend your access to the Platform and seek legal remedies if you engage in prohibited conduct.
9. Limitation of Liability
To the fullest extent permissible by applicable Indian laws, The Pure Dentistry, its owners, directors, licensed dentists, employees, and affiliates shall bear NO liability to you for any direct, indirect, incidental, special, reliance, consequential, or punitive damages arising from:
- Your access to, use of, or inability to use the Platform.
- Any errors, omissions, or inaccuracies in the content provided on the Platform.
- Unauthorized access to or alteration of your medical data due to circumstances beyond our reasonable control.
- Actions taken based on the general information provided on the Platform without formal professional consultation.
In jurisdictions that do not allow the exclusion of certain warranties or limitations of liability, our liability shall be limited to the maximum extent permitted by the laws of India.
10. Indemnification
You agree to defend, indemnify, and hold harmless The Pure Dentistry, its practitioners, and affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your misuse of the Platform.
11. Governing Law and Jurisdiction
These Terms of Use, your use of the Platform, and any disputes arising therefrom shall be governed by and construed in accordance with the laws of the Republic of India, without regard to its conflict of law provisions.
Exclusive Jurisdiction: You unconditionally agree that any legal action, suit, or proceeding arising out of or relating to these Terms or the services provided by The Pure Dentistry shall be instituted exclusively in the competent courts located in Hyderabad, Telangana, India. You hereby consent to the exclusive jurisdiction and venue of such courts.
12. International Users
While The Pure Dentistry serves patients globally, our Platform is operated from India. We make no representation that the Platform or its content is appropriate or available for use outside India. If you access the Platform from jurisdictions outside India, you do so on your own initiative and are solely responsible for compliance with local laws regarding online conduct, acceptable content, and the transmission of data.
13. Severability and Waiver
If any provision of these Terms is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
14. Modifications to the Terms
We reserve the right, at our sole discretion, to update, modify, or replace these Terms at any time without prior notice. The "Last Updated" date at the top of this page will reflect the most recent revisions. Your continued use of the Platform following the posting of any changes constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.
